Ontario Form 13C: Comparison of Net Family Property Statements
Form 13C puts both parties' positions on every net family property item side by side, so everyone can see exactly where the numbers differ before the settlement conference. Here is how it works, when it is prepared, the mistakes to avoid, and how Divo prepares a draft.

What Form 13C is and when it's used
Form 13C compares the parties' net family property statements. It follows the same structure as the financial statement and Form 13B: assets owned on the valuation date in seven categories (land; household items and vehicles; bank accounts, savings, securities and pensions; life and disability insurance; business interests; money owed; other property), debts and other liabilities on the valuation date, the net value of property (other than a matrimonial home) and debts on the date of marriage, and property excluded under subsection 4(2) of the Family Law Act.
For each item the form records comments, a document number, and four values: the applicant's position on the applicant's and the respondent's figures, and the respondent's position on both. The totals run through to each spouse's net family property under each party's position, and a final section shows the equalization payment each position produces, in either direction.
Laid out this way, agreed items show the same numbers under both positions and disputed items stand out. That is the point of the form: narrowing the property issues before the settlement conference.
Who prepares, serves and files it, and when
The form's instructions say it is completed once both parties have completed and exchanged their Net Family Property Statements (Form 13B). The parties can complete it jointly and file it with the court six days before the settlement conference. If they can't agree, each party prepares their own, serves it on the other party and files it before the settlement conference.
Timing turns on who asked for the conference. The party who requested the settlement conference serves and files six days before it, even for a joint statement. If no joint statement has been filed, the other party serves and files four days before. The form has a box showing whether it was prepared by the applicant, the respondent, or both jointly.
Documents that feed it
- Both parties' Form 13B statements. The starting point for both positions.
- Both parties' Form 13.1 financial statements. The sworn values behind each 13B.
- The disclosure behind each figure. So each line can cite a document number and disputed values can be checked quickly.
- Valuation material for disputed items. Real estate appraisals, pension valuations and business valuations, where the parties' values differ.
Common mistakes on a Form 13C
- Preparing it too early. The form is completed after both parties have exchanged their Form 13B statements, not from one side's figures alone.
- Positions that don't match the party's own 13B. Each party's position columns should reflect that party's statement. A comparison that quietly changes a party's numbers creates a new dispute instead of narrowing one.
- An empty document number column. Without references, disputed values can't be checked against the disclosure quickly.
- Totals that don't follow the form's arithmetic. Total 5 is debts plus date-of-marriage property plus excluded property, and net family property is Total 1 minus Total 5, under each party's position.
- Missing the conference timing. Joint or separate, the requesting party serves and files first. A late comparison leaves the conference without the document meant to focus it.
How Divo prepares a draft Form 13C
Form 13C is in Divo's property and support package with Forms 13.1, 13A and 13B, drafted on the official May 2021 version.
- Open the matter from Clio (Canada region), from Actionstep through your firm's own Zapier account, or from Dropbox or Box, or upload the documents.
- AI reads the property, debt and exclusion records and extracts the facts, each linked to the document and page it came from.
- A lawyer or clerk reviews the extracted facts. Values that match their source can be approved together; conflicts between documents, and missing values, are flagged for a person to resolve.
- Divo drafts the comparison from the property and debt facts your team approved for both spouses and the deterministic net family property calculation behind your client's Form 13B. Values the approved facts don't support, such as the other party's position on a disputed item, are left for your team to complete rather than guessed.
- Divo prepares the 13C as an editable Word draft for lawyer review and can send it back to the Clio matter or your firm's Dropbox or Box. Divo files nothing.

Frequently asked questions
Can Form 13C be prepared jointly?
Yes. The form's instructions say the parties can complete it jointly. If they can't agree on it, each party prepares their own, serves it on the other and files it before the settlement conference.
When is Form 13C used?
Before the settlement conference, once both parties have completed and exchanged their Form 13B statements. The form's instructions set the timing by who requested the conference.
What is the difference between Form 13B and Form 13C?
Form 13B is one party's calculation of both spouses' net family property. Form 13C sets the applicant's position and the respondent's position next to each other for every item, so the differences between the two 13Bs are visible line by line.
Is there a PDF version of Form 13C?
When this page was reviewed, the official Ontario Court Forms site offered the May 2021 Form 13C as a Word file.
